On May 3, 2013, Justice Abuodha delivered his Ruling in the case of Agnes Wamae & 104 Others v Barclays Bank of Kenya Limited. Ruling in favour of the Bank, the Judge held that a payment made on account of redundancy would not be unlawful where the sum total of what was paid met the statutory requirements, notwithstanding the fact that the formula used to calculate the compensation contained a departure from what is contained in statute. The Court also held that a letter of release and discharge would be respected by the Court unless there is evidence that it was obtained unconscionably or by unfairness.
