Overview

Simon graduated with a Bachelor of Laws degree from Catholic University of Eastern Africa in the year 2012 and a Postgraduate Diploma in Law from the Kenya School of Law in the year 2013.

He also holds a Certificate in Copyright X from Harvard University and is also a licensed Patent Agent before the Kenya Industrial Property Institute. He was called to the bar in the year 2014.

  • Attending to the Perfection and registration of a Supplemental Charge, an all Asset Debenture, Deed of Indemnity and Guarantee, Composite Debenture and Guarantee, Deed of Subordination, Escrow Agreements and a Deed of Pledge to secure the sum of Kshs. 3,874,500,000.00 in favor of a Bank institution in Kenya.
  • Drafting and proffering Advisory on commercial contracts including Share Purchase Agreements, Settlement Agreements, Deeds of Variation, Shareholders Agreements, Asset Purchase Agreements, Non-Compete Agreements, Consortia Agreements, Non -Disclosure Agreements and attendant Due Diligence Reports.
  • Transaction Advisory Services including more recently advising a leading LPG business player in a proposed sale of its retail business and disposition of its other assets. I have also participated in proffering advisory services where a refineries company was being acquired by a Parastatal and advising a renewable energy company on compliance requirements in a proposed land acquisition along the Nyamindi Cascade to generate hydro-power.
  • Undertaking Technical Peer Review in Credit Market Development for Financial Sector Deepening (FSD) in conjunction with the World Bank, International Monetary Organization, Ministry of Finance and The Attorney General’s Office to reform the Movable Collateral System in Kenya, review the Legislative Proposals aimed at developing a new Secured Transactions Law (Movable Property Security Rights Bill, 2016) and establishment of an Electronic Collateral Register.
  • Preparation, filing and registration of various Intellectual Properties such as Copyrights, Trademarks, Patents, Utility Models and Industrial designs; prosecuting claims in instances of breach of Intellectual Property Rights as well preparing advisory opinions on the registration, infringement and enforcement.
  • Drafting of various Commercial and IP related Agreements including Joint Ventures, Merger and Acquisitions, De-mergers, Escrow Agreements ,Deeds of Subordination, Trust Deeds, Partnership Deeds, technology transfer agreements, licensing ,assignments, privacy and disclosure, annual maintenance contracts and Value Added Reseller Agreements.
  • Successfully represented Kenya Bureau of Standards (KEBS) before the Public Procurement Administrative Board [PPARB] in Public Procurement Litigation in an Application where the aggrieved party; East African Automobile Services Co. Ltd [EASS] sought to review the award of a Motor Vehicle inspection Contract with a market value of over Kshs 3.2 Billion to the successful bidder; Quality Inspection Services Inc. Japan)[QISJ];
  • Successfully represented Kenya Bureau of Standards (KEBS) before the Public Procurement Administrative Board [PPARB] in Public Procurement Litigation in an Application where the aggrieved party; Japan Export Vehicle Inspection Centre Co Ltd [JEVIC] sought to review the awarding of a Motor Vehicle inspection Contract with a market value of over Kshs 3.2 Billion to the successful bidder; Quality Inspection Services Inc.
